Defamation/Invasion of Privacy

Gary Marder, et al. v. TEGNA Inc., et al., No. 19-81283-CIV-SMITH, 2020 WL 3496447 (S.D. Fla. June 29, 2020). Won dismissal of defamation claims against TEGNA, Gannett Co., Inc. and News Corp. brought by a South Florida physician seeking more than $200 million in damages.

W.P. Productions, Inc. v. Tramontina U.S.A., Inc. and Sam’s West, Inc., No. 18-cv-63162, 2020 WL 3566400 (S.D. Fla. June 12, 2020). Representing a manufacturer of cookware sets sold to major U.S. retailers, won summary judgment on 15 million dollar defamation and tortious interference claims.

Media and Entertainment

Associated Press v. Agency for Health Care Administration, Case No. 2020 CA 000812 (Fla. 2d Cir. Ct. 2020). Successfully obtained public records regarding COVID-19 infections and deaths present in long-term care facilities in Florida.

Schwarz v. The Villages, Inc., et al., Case No. 5:18-cv-Oc-34PRL (M.D. Fla. Feb. 19, 2020). Obtained a dismissal with prejudice of a defamation claim against a number of corporate entities in The Villages for statements made in a Villages Daily Sun article.

Bernstein, et al. v. Larson Shannahan Slifka Group, LLC, et al. (Fla. 13th Jud. Cir. Ct. 2020). Won dismissal with prejudice, based upon official immunity, of defamation and conspiracy claims arising out of ammunition procurement contract for U.S. Special Operations Command.

Chris Payton v. WPLG, Graham Media Group, et al., Case No.15-6296-CA01 (Fla. 11th Cir. Ct. 2020). Obtained voluntary dismissal by former municipal official of defamation suit after discovery and service of sanctions motion pursuant to Florida’s analogue to federal Rule 11.

Rodriguez v. OfferUp, Inc., et al.

Case No. 8:19-CV-1290-T-30SPF (M.D. Fla. Aug. 29, 2019).  Won dismissal with prejudice of fraud and negligence claims against internet service provider based upon Section 230 of the Communications Decency Act.

Gottwald v. Geragos, et al., N.Y., County Index No. 162075/14, 2019 WL 1938517 (N.Y. App. Div. May 2, 2019).  Obtained affirmance of discovery order in representation of celebrity-lawyer Mark Geragos’ law firm in a defamation brought by famed music producer Lukasz “Dr. Luke” Gottwald.

Folta v. The New York Times Company, et al., No. 1:17-cv-256-MW/GRJ, 2019 WL 486776 (N.D. Fla. Feb. 27, 2019), appeal dismissed, No. 19-10988-HH (11th Cir. Apr. 9, 2019).  Won summary judgment for The New York Times and journalist Eric Lipton in defamation case involving news story profiling relationships between public university professors and the biotechnology and organic food industries concerning the safety and regulation of G.M.O. food products.

DeMartini v. Town of Gulfstream, et al.

942 F.3d 1277 (11th Cir. 2019). Won affirmance of summary judgment on malicious prosecution claim arising from public records dispute and related RICO lawsuit.

Grigorian v. FCA US, LLC

(S.D. Fla. 2019).  Obtained voluntary dismissal of indemnity and breach of contract claims against advertising agency in TCPA class action case.

Defamation/Invasion of Privacy

Russell v. Waterman Broadcasting Corp, et al. (Fla. 20th Jud. Cir. 2019).  Won summary judgment for reporter in public official defamation lawsuit brought by state attorney.

Defamation/Invasion of Privacy

Nix v. Major League Baseball et al., 62 F.4th 920 (5th Cir. 2023), and Nix v. ESPN, Inc., 772 Fed. Appx. 807 (11th Cir. 2019). Won dismissal and appeals of libel actions that former professional baseball player brought against The Associated Press, ESPN and USA Today.

Intellectual Property

Rodriguez v. OfferUp, Inc., 8:19-cv-1290-T-30SPF (M.D. Fla. 2019). Obtained, as local counsel, a dismissal with prejudice of tort claims against an Internet service provider (ISP) based on Section 230 immunity.
